what happens. a deputy appears to run in and hold a batten at the man's neck. as the man goes down, deputies appear to knee him repeatedly. >> they kept hitting him. and he was put in handcuffs. he was handcuffed on the floor, and they start kneeing him again and punching him on his head. >> you're only seeing a small snapshot of the whole thing. >> reporter: the sheriff's spokesman claims the man was resisting arrest, even threatening deputy at one point. he said all deputies could do was respond from force. >> i saw what looked to be a punch from the deputy, is that is in policy. >> reporter: oakland seems to have a policy where they will swing first, question later. a smoldering crash site, and now we are learning that there are two victims. what witnesses heard just before the crash. >> what authorities are saying about a deadly shark attack on the california coast.

contra costa county: a secod body has b wreckage. new details in the fiery plane crash out of contra costa county. a second body has been found in the wreckage. small plane came down north neat of the byron airport. the witnesses say they heard the engine of the plane sputter before it crashed in a farm field at about 2:00 this afternoon. wreckage was smile smoldering an hour later. names of the two have not been

identified. faa is investigating the cause of the crash. a central coast man is dead after being attacked by a shark. it happened at surf beach near and haven burg air force base in santa barbara county this morning. francisco solario was surfing with a a friend who saw the attack. the friend drug him to the beach and tried to save his life, but was unsuccessful. no signs are posted warning of shark attacks, but officials say that surfers know of the danger. >> i think it's pretty well known locally, like you said, that there are sharks, and we've had sharks up and down the santa barbara coastline pretty frequently recently. >> there are about 65 shark attacks every year around the world. in july, a man escaped injury near santa cruz after being thrown from his kayak when a shark bit through his boat.

well, investigators say they could actually see with their naked eyes black specks of fungus floating in vials of steroids prepared by the new england compounding center. that's the place that is said to be the source of the meningitis outbreak in 17 states. 300 people are sick tonight. 23 have died. health officials say the outbreak is spreading. >> reporter: the preliminary investigation has revealed a lack of basic laboratory standards at new england compounding center. today massachusetts state investigators found that necc had dirty floor mats on a leaky boiler, did not properly test lab equipment, did not adequately sterilize medications, and shipped drugs before they were tested for contamination. the doctor lead it will the investigation for the department of health spoke. >> on 13 occasions, necc staff shipped orders from the suspect

lots before receiving their own test results confirming that those lots were sterile. >> reporter: officials also claim the company broke state law by shipping their products in bulk without precipitations. -- without prescriptions. more than 17,000 vials of the suspect steroid went to clinics in 23 states. documents released yesterday show that complaints against necc for lack of individual prescriptions date back to 1999. the co-owner barry cadon said in 2004 that his company would abide by the law, quote: the state and the fda made a joint inspection of the facility in 2004. sheldon brad shoe was the fda's chief counsel. >> tippic him the fda would go back in and reinspect, but here
